1. service description

Coworking Bad Aussee provides the user with office workstations, a meeting room and technical office infrastructure. The customer receives a key or code with which he can gain access to his workstation. 

The workstations are regularly equipped with a table, an office chair, electricity and Internet access (WLAN). In addition, the shared use of printer/copier/scanner and a kitchenette with basic equipment is included.

Coworking Bad Aussee offers the provision of lockable boxes for the purpose of storing items at your own risk, as well as other additional services such as the provision of a company sign, and the possibility of registering the company at the address of the office premises.


2. scope of application

Coworking Bad Aussee provides services exclusively on the basis of these General Terms and Conditions. These apply to all contractual partners for all services provided by Coworking Bad Aussee as well as for all infrastructure provided, even if no express reference is made to these terms and conditions.

Coworking Bad Aussee reserves the right to amend the General Terms and Conditions. However, amendments as well as collateral agreements, reservations or supplements must be made in writing.

Conflicting terms and conditions of contractual partners shall only become effective if Coworking Bad Aussee has expressly acknowledged them in writing in advance.


3 Conclusion of contract

All offers made in writing by Coworking Bad Aussee are subject to change and non-binding. For the conclusion of a binding contract, a written reservation confirmation by Coworking Bad Aussee is required, unless Coworking Bad Aussee indicates that the order has been accepted.

In order to establish the business relationship, a valid official photo ID or, in the case of companies, a current excerpt from the commercial register must be presented. This must be presented by the customer at the latest on the first day of the rental of the workspace.

4. terms of use

The customer is obliged to provide Coworking Bad Aussee with all information and documents required for the provision of services. In addition, the customer must inform Coworking Bad Aussee of all circumstances that are relevant for the provision of services, even if these only become known during the provision of services. The premises and workstations may only be used for the purpose specified by Coworking Bad Aussee. Any change of purpose requires the express written consent of Coworking Bad Aussee. The customer may not use the services provided in a way that leads to damage, destruction, overloading or other unusability of the infrastructure provided by Coworking Bad Aussee or causes disturbances for other users. Smoking in the building and in particular in the office premises is strictly prohibited. Furthermore, the customer undertakes to comply with the house rules.

The Customer undertakes to treat as confidential all information of which it becomes aware in the course of the performance of the contract. Furthermore, the customer may not use the infrastructure for illegal business or activities of any kind. Internet use must be appropriate and calling up and downloading illegal or offensive content is strictly prohibited. The customer shall receive a key for the use of the building, which may not be passed on to third parties. The customer is responsible for keeping the key safe and is liable for any damage or loss. When leaving the premises, they must be properly locked. The workspace (as well as the box) must be vacated and free of items upon termination of the contract.

The possibility of use is not transferable, the contract is personalized and may not be passed on.

The customer is aware that Coworking Bad Aussee will host events several times a year. Coworking Bad Aussee will announce such events with a reasonable lead time. The customer shall tolerate without compensation any adverse effects resulting therefrom for the customer (e.g. restricted access, re-furnishing, noise pollution).

5. withdrawal from the contract

The customer has the right to withdraw from the contract within two weeks before the agreed date for the start of the service without giving any reason. Any cancellation must be made in writing. In case of Monthly Desk tariff, the customer has to pay the difference depending on the agreed binding. In case of cancellation within the last two weeks before the start of the service, a fee of 50% of the agreed invoice amount will be charged.

Coworking Bad Aussee has the right to withdraw from the contract up to four weeks before the agreed date for the start of services without a down payment.

Coworking Bad Aussee reserves the right to withdraw from the contract without observing any deadlines if there are justified concerns regarding the creditworthiness of the customer and the customer refuses to pay a security deposit.


6. terms of payment

Invoicing for the tariffs "Daily Desk", "Weekly Desk" and "Meeting Room" shall take place before the start of use. The agreed fee is due immediately. 

Invoicing for the tariffs "Monthly Desk" and "Company Address" takes place at the beginning of each calendar month. The agreed fee is due from the date of the invoice and must be paid within seven calendar days of receipt of the invoice. In the event of a delay in payment, the statutory interest on arrears shall apply.

A set-off of counterclaims on the part of the customer is excluded, unless the existence of such counterclaims has been expressly acknowledged in writing by Coworking Bad Aussee in advance.

The method of payment shall be determined in advance.

7. data protection

Personal data will be stored and processed exclusively for the purpose of processing the contractual relationship, for individual support or for sending offers and product information. All data will be treated confidentially and will not be passed on to third parties in accordance with data protection regulations. Data may only be passed on after obtaining the express permission of the customer, except in the case of legal obligations to provide information for the purposes of criminal prosecution by law enforcement agencies and courts. Personal data will be handled strictly within the framework of the respective legal provisions.

This contractual relationship does not entitle the customer to any protection against competition or rivalry; in particular, the customer is not entitled to any claim against Coworking Bad Aussee due to the behavior of other customers.


8 Liability

Coworking Bad Aussee is liable within the framework of the statutory provisions only for damages caused by intent or gross negligence of its employees or agents. Liability for slight negligence is excluded.

No liability is assumed for lost objects in the office premises.

9. final provisions

All legal relations between Coworking Bad Aussee and the customer are exclusively subject to Austrian law, excluding international reference standards. The place of performance and jurisdiction for all claims and disputes arising from this contract is Liezen, Styria.

Should individual clauses be invalid due to the applicable legal situation, the remaining clauses shall remain unaffected in their content and validity. The wholly or partially invalid provisions shall be replaced by such provisions that come as close as possible to the original intention of the parties.
